These Terms & Conditions govern purchases, subscriptions, custom orders, and services offered through Sunshine Flowers Studio.
Sunshine Flowers Studio is operated by Sunshine Flowers LLC, a California limited liability company (“Sunshine Flowers,” “we,” “us,” or “our”).
By placing an order, enrolling in a subscription, approving a custom proposal, or otherwise purchasing products or services through our website, you agree to these Terms & Conditions.
Products & Availability
Flowers are natural, seasonal products. Individual blooms, varieties, colors, sizes, shapes, and overall compositions may vary naturally from photographs displayed on our website.
Product photography represents the general style, palette, scale, and character of an arrangement and is not intended to guarantee the exact appearance of every individual flower.
Availability may change daily based on season, market conditions, and supplier availability.
Floral Substitutions
When a particular flower, color, or vessel is unavailable, our designers may make a thoughtful substitution using materials of equal or greater quality and value, while preserving the intended palette, style, balance, and overall character of the arrangement as closely as reasonably possible.
Natural variations and appropriate floral substitutions are part of bespoke floral design and are not considered defects when the overall quality and value of the arrangement are maintained.
Pricing
All prices are displayed in U.S. dollars.
Applicable sales tax is calculated based on the transaction and added at checkout where required by law.
Delivery charges, where applicable, are calculated based on the delivery location and are presented before the order is completed.
The total amount payable, including applicable taxes and delivery charges, will be displayed before payment is submitted.
Payment
Payment authorization must be successfully completed before a standard online order is confirmed.
Payments may be processed through third-party payment providers made available on our website.
We reserve the right to correct genuine pricing, technical, or typographical errors before accepting or fulfilling an order. If a material pricing error affects an order that has already been submitted, we will contact the customer before proceeding.
Order Acceptance
Submission of an order does not by itself guarantee acceptance.
An order is considered accepted once payment has been authorized and we have confirmed that the order can be fulfilled.
We may contact the customer if additional information is reasonably required to prepare or deliver an order.
If we cannot accept or fulfill an order, any amount collected for the unfulfilled portion of that order will be handled in accordance with applicable law and our Client Care & Floral Guarantee.
Delivery
Delivery availability, timing, pricing, and service areas depend on the delivery location and availability.
Customers should review our Delivery Policy for current delivery information.
Requested delivery times are requests rather than guarantees unless we expressly confirm otherwise in writing.
Recipient Information
Customers are responsible for providing complete and accurate information necessary to complete delivery, including where applicable:
• Recipient name
• Complete delivery address
• ZIP code
• Recipient telephone number
• Apartment, suite, building, or unit number
• Gate codes or access instructions
• Any other information reasonably necessary to access the delivery location
Incorrect or incomplete information may cause delays, failed delivery, or additional delivery charges.
Custom Floral Orders
Submission of a custom floral inquiry does not create a finalized purchase or require us to accept the requested project.
Our design team may review the requested flowers, aesthetic, event details, timing, availability, installation requirements, and budget before providing a proposal or final quote.
The final price may differ from an estimated budget submitted through an inquiry form.
A custom order becomes binding only after the applicable proposal or order is approved and any required payment or deposit has been completed.
Custom, wedding, event, corporate, and installation services may be subject to additional written terms.
Subscriptions
Recurring floral subscriptions are governed by our separate Subscription Terms, which form part of these Terms & Conditions.
Before a recurring subscription is completed, applicable recurring charges, billing frequency, renewal terms, and cancellation methods will be presented to the customer.
Cancellations, Quality Concerns & Refunds
Please review our Client Care & Floral Guarantee for policies concerning order cancellations, floral quality concerns, substitutions, failed deliveries, replacements, credits, and refunds.
Nothing in these Terms limits any non-waivable rights or remedies available to a consumer under applicable law.
Intellectual Property
Unless otherwise stated, the website and its original photographs, floral imagery, graphics, text, branding, design elements, logos, and other original creative materials are owned by or licensed to Sunshine Flowers LLC.
They may not be copied, reproduced, distributed, published, modified, or used commercially without prior authorization, except as otherwise permitted by law.
Website Use
You may use this website for lawful personal or business purchasing purposes.
You may not intentionally interfere with the operation or security of the website, misuse its content, attempt unauthorized access to systems or accounts, or use the website for unlawful or fraudulent activities.
Events Beyond Our Reasonable Control
To the extent permitted by applicable law, Sunshine Flowers is not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, road closures, accidents, emergencies, government restrictions, building-access restrictions, supply disruptions, or comparable unforeseen conditions.
Where such circumstances affect an order, we will make reasonable efforts to communicate with the customer and determine an appropriate solution.
Nothing in this section excludes or limits liability or consumer rights that cannot legally be excluded or limited.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, operations, or applicable requirements.
The version in effect when an order is placed will generally govern that order unless applicable law requires otherwise.
Governing Law
These Terms are governed by applicable laws of the State of California and applicable federal law, without limiting any consumer protections that cannot lawfully be waived.
